He was sentenced to death but the state chose not to carry out the sentence. Gilmore sued in court for his right to be executed otherwise the state had to set him free because his sentence did not include life in prison. If he won his case he had a choice of executions: hanging or firing squad. Very unusual interview. Also a great article on Howard Hughe's secret file.
